Terms and Conditions for the Defining Electric Campaign competition to win tickets to The Open Championship and Mercedes-Benz Hospitality at the British Grand Prix (the “Event”)
The following terms and conditions apply to the Draw:
The Promoter is Mercedes-Benz UK Limited (Company Number 02448457) whose registered address is Delaware Drive, Tongwell, Milton Keynes, England, MK15 8BA (the “Promoter”).
Interpretation
In these terms and conditions, references to masculine include the feminine and the neuter and to the singular include the plural and vice versa as the context admits or requires.
Headings are used for reference only and do not constitute terms of this contract.
Eligibility & Entering
1. The Promoter’s customers (the “Entrants”) may enter into a free prize draw (the “Draw”) for a chance to win a pair of tickets to the Mercedes-Benz Hospitality at the British Grand Prix Tour (Saturday 6 July) and/or a day General Admission ticket to The Open Championship, Royal Troon (either Thursday 18, Friday 19, Saturday 20 or Sunday 21 July) (the “Prize”).
2. For a chance to win the Prize, the Entrants will need to do one of the following:
(a) take an extended test drive of a Mercedes-Benz for a minimum period of 24 hours between 1 June to 20 June 2024. The Entrants should speak to an agent in their local Mercedes-Benz Showroom onsite and consent to providing their customer information directly with an agent, using the online OneWeb form; or
(b) purchase a new electric Mercedes-Benz between 1 June to 20 June 2024.
3. The Entrants must hold a full UK driving licence.
4. The Entrants must reside in the UK and be aged 18 or older at the time of entry.
5. Any entries received either before the Start Date and/or after the Closing Date will not be entered into the Draw.
6. There is a limit of one entry per household.
7. The Draw is open to Retail and Small Business customers only.
8. Employees of the Promoter and its group companies, their agencies and families, dealer network and anyone professionally connected with the Draw are not eligible to enter.
9. The Promoter accepts no responsibility for entries not successfully completed due to a technical fault, technical malfunction, computer hardware or software failure, satellite, network or server failure of any kind.
10. No purchase is necessary.
The Prize Draw
11. The 2 winners of a pair of tickets (winner plus guest, total 4) for the Mercedes-Benz hospitality at the British Grand Prix on Saturday 6 July 2024 will be selected at random on Monday 24 June from all valid entries received (each a “Winner” and together the “Winners”). The selection of the Winners shall be conducted by the Promoter under the supervision of an independent observer, and the selection and date offered of the prize offered will be final.
12. The 4 winners of a pair of tickets (winner plus guest, total 8) for General Admission at the Open Championship at The Royal Troon on either Thursday 18 July (x 1 pair), Friday 19 July (x 1 pair), Saturday 20 July (x1 pair) or Sunday 21 July (x1 pair) will be selected at random on Monday 24 June from all valid entries received (each a “Winner” and together the “Winners”). The selection of the Winners shall be conducted by the Promoter under the supervision of an independent observer, and the selection and date offered of the prize offered will be final.
13. Once the Winners have been selected, they will be notified via telephone from Monday 24 June (“Notification Date”).
14. Each Winner will receive one pair of tickets to the Event, one pass for themselves and one pass for a guest of their choosing (the “Guest”). Winners must inform the Promoter of the name of their Guest when they are contacted pursuant to clause 10. Guests must be aged 18 or older.
15. Winners will receive a confirmation email with joining instructions. Winners and Guests will be included on a guest list for the Event.
16. In the event that the Promoter is unable to make contact with any Winner within 48 hours of the Notification Date, the Promoter may elect to select a new winner from the remaining entrants.
17. The decision of the Promoter regarding any aspect of the Prize draw is final and binding and no correspondence will be entered into about it.
18. Any entrant and/or participant who has provided false or misleading information and/or has breached these terms and conditions will be immediately disqualified from the Draw.
The Prize
19. The Prize is available on the dates set out above only, and no alternative dates shall be available. If any Winner is unable to attend on the dates set out above, they shall inform the Promoter and the Promoter shall be entitled to select a new Winner from the remaining Entrants.
20. There is no cash alternative available, and the Prize is non-refundable and non-transferable.
21. The Promoter reserves the right to replace the Prize with an alternative Prize of equal or higher value if circumstances beyond the Promoter's control makes it necessary to do so.
22. The Promoter reserves the right to withhold any Prize under these terms and conditions if they have been breached. In the event of breach, the Draw may be re-opened.
23. The Prize may not be sold, offered for sale, used for competitions, coupled or bundled with any other product or services, or used for any commercial or promotional purposes whatsoever.
24. Winners and their Guests are responsible for their own travel costs to and from the Event.
25. Guests will be asked to complete a consent form to allow the promoter to film/ take picture of the event. This will include the option to be excluded/deny consent.
26. The Promoter does not accept any responsibility if you are not able to take up the Prize.
General
27. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these terms and conditions and the remaining clauses shall survive, remain in full force and effect.
28. Entry into the Draw shall constitute your acceptance of these terms and conditions. The Promoter reserves the right to refuse entry or refuse to award the Prize to anyone in breach of these terms and conditions.
29. Winners will have the opportunity to be excluded from any filming/photography.
30. The Promoter reserves the right to withdraw, postpone and/or amend the Draw and/or the Event at any time without notice.
31. The Promoter is providing tickets to the Open Championship 2024 & Mercedes-Benz Hospitality at the British Grand Prix. The Promoter accepts no liability arising out of or in connection with the Event.
32. Insofar as is permitted by law, the Promoter, its agents, or distributors will not in any circumstances be responsible or liable to compensate the Winner or accept any liability for any loss, damage, personal injury, or death occurring as a result of taking up the Prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
33. The Promoter shall not be liable for any failure to comply with its obligations where the failure is caused by something outside its reasonable control. Such circumstances shall include, but not be limited to, weather conditions, fire, flood, hurricane, strike, industrial dispute, war, hostilities, political unrest, riots, civil commotion, pandemic, epidemic, inevitable accidents, supervening legislation, technical and computer faults, system failures, network errors, website unavailability, hacks on the system, personal computer issues, failures and malfunctions or any other circumstances amounting to force majeure or any other issue out of our reasonable control.
34. The Promoter will only process your personal information as set out in the Privacy Policy (mercedes-benz.co.uk)
35. These terms and conditions shall be governed and construed and have effect in all respects in accordance with English Law and the courts of England shall have exclusive jurisdiction over any proceedings arising out of or in connection with them.
